JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner, informant and the learned A.P.P. for the State. The Petitioner seeks bail in Gopalpur P.S. Case No. 37 of 2016, pending in the Court of 1st Additional District & Sessions Judge, Naugachia instituted for the offence under Section(s) 147, 148, 341, 307, 302, 34 of the Indian Penal Code. The petitioner is alleged to be the main assailant. There is allegation against this petitioner that he fired on right Panjra of the brother of the informant. He fell down and succumbed to the injuries.
The Sessions Judge has mentioned in the impugned order that postmortem report as mentioned in para 31 of the case diary reflects that cause of death has been mentioned as
Patna High Court Cr.Misc. No.9625 of 2017 (2) dt.11-04-2017 2/2 haemorrhage and shock due to injury caused by fire arm from the range of about six feet.
In such circumstance, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
The Court below is directed to expedite the trial.
