JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 323, 307, 384, 504 of the Indian Penal Code and u/s 25(1-b)a, 26, 27 of Arms Act. . As per the prosecution case, on the alleged date and time of occurrence while the informant was on his construction site, this petitioner came and demanded extortion of Rs. One lakh and on refusal he fired upon the informant but the shot missed the target. The informant raised alarm and snatched the Katta from the petitioner thereafter the petitioner fled away. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to old enmity. No one sustained any injury. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is specific allegation against this petitioner of demanding extortion. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
