The petitioner is accused in connection with Kotwali P.S. Case No. 48/2017, registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

On receiving secret information about unloading the illicit liquor in the campus of Brajesh Shankar Lal at Mohallah Purabsarai, the police reached there. One person was found sitting in a Scorpio, while he tried to flee away, but he was apprehended, who disclosed the name Chandan Kumar. On search, 216 bottles, each containing 375ml., Indian made foreign liquor recovered from the Scorpio. Chandan Kumar disclosed that liquor is of Deepak Kumar Paswan of Makaspur, P.S. Kasim Bazaar and his

Thereafter, the house was searched, from where, 96 bottles, each containing 180ml., 33 bottles, each containing 750ml., and 119 bottles, each containing 375ml., Indian made foreign liquor recovered. Santosh Kumar Sah (Petitioner) and Neeraj Kumar were also apprehended there who disclosed about selling of liquor with Deepak Kumar Paswan. Submission is that the petitioner and one Neeraj Kumar were engaged for unloading the cartons and due to misconception they have also been implicated in the present case. Further submission is that the petitioner is in custody since 15.02.2017.

Having regard to the facts and the circumstances of the case, the petitioner, Santosh Kumar Sah, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S.
