JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-01-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Kurhani (Kudhani) P.S. Case No. 337 of 2013 for the offences punishable under sections 147, 148, 149, 447, 452, 341, 323, 307, 379, 380, 354, 427, 504, 506 and 188 of the I.P.C and section 10 of the U.A.P. Act. At the very out set, it is submitted that in this case other co-accused, namely, Saryug Mahto and other 16 have been allowed pre-arrest bail vide Cr. Misc. No. 45710 of 2015 by order dated 14.10.2015 by another co-ordinate Bench of this Court and the case of the petitioners is similar to those co-accused. The

Patna High Court Cr.Misc. No.1957 of 2017 (2) dt.20-01-2017 2/2 petitioners have clean antecedents and as such they also deserve sympathetic consideration in this false case. The learned A.P.P. fairly submits that Saryug Mahto and others have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of.
