This application for anticipatory bail arises out of Parihar P.S. Case No. 47 of 2021 for the offence punishable under Sections 363, 365, 376(2)(G), 376(D) and 354(D) of the Indian Penal Code and under Sections 6, 8, 9 and 10 of the POCSO Act.
This is a serious case in which this Court is not inclined to grant anticipatory bail to the petitioner though it has been submitted by learned counsel for the petitioner that due to land dispute the petitioner and other accused persons have been falsely implicated in this case and in the trial the victim girl has not supported the prosecution case against this petitioner and
Patna High Court CR. MISC. No.64350 of 2021(2) dt.26-05-2022 2/2 other accused persons.
This anticipatory bail application is disposed of with a direction to the petitioner to surrender in the Court below and pray for regular bail. The Court below will consider the regular bail of the petitioner in light of the aforesaid submission of learned counsel for the petitioner and if the victim girl has not supported the prosecution case so far as this petitioner is concerned, I see no reason that the Court below will not consider the case of regular bail of this petitioner favourably.
