2. The petitioner seeks bail in connection with RPF (Sasaram) PS Case No.04 of 2023 dated 15.05.2023, instituted for the offence punishable under Section 3 of the Railway Property (Unlawful Possession) Act.

3. As per the FIR, the petitioner was found taking away 14 pandrol clips. Upon chase, he started fleeing away after throwing the same but he was apprehended by the police. The cost of the articles, which were stolen by the petitioner, is said to be Rs.1,120/-.

4. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Only on suspicion, the petitioner has been made

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Gaya, in RPF (Sasaram) PS Case No.04 of 2023.

7. The application stands allowed.
