JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 363, 365/34 of the Indian Penal Code later on Section 302/201 has been added.

Accusation is that in the evening of 03.08.2016 Brajesh Kumar @ Vijay son of the informant (Photo Devi) was accompanied with Ram Daresh Rai @ Chhotu but he did not return back. To know about her son she went to the house of Ram Daresh Rai but no proper reply was given by him. Further allegation is that Ramesh Rai had threatened her son making complaint about teasing his daughter. The informant further alleged that in conspiracy Rajaram Rai, Vikash Kumar and

Patna High Court Cr.Misc. No.20046 of 2017 (2) dt.10-05-2017 2/2 Pappu Rai disappeared her son.

Submission is that except suspicion raised by the informant, no material has been collected by the investigating officer against the petitioner. Similarly other co-accused, namely, Pappu Kumar @ Pappy Ray has been granted bail by a bench of this Court on 08.04.2017 in Cr. Misc. No. 11974 of 2017.The petitioner having no criminal antecedent is in custody since 16.11.2016.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Kalyanpur P.S.Case No. 104/2016.
