Petitioner seeks regular bail in connection with Koilwar P.S. Case No. 141 of 2021 registered for the offence punishable under Sections 399 / 402 / 414 / 34 of the Indian Penal Code and under Section 25(1-b)a / 26 / 35 of the Arms Act.

The police got an information that five miscreants have gathered near Kulharia More and were preparing to commit loot. On the basis of said information, the police raided the place of occurrence and arrested four persons and recovered mobile phone, cash of Rs. 24,000/-, motorcycle and other articles from the accused persons. However, the petitioner succeeded in fleeing away.

Learned counsel for the petitioner submits that petitioner has been made accused on the basis of disclosure of his name by arrested accused persons. He next submits that no

Patna High Court CR. MISC. No.64005 of 2021(3) dt.05-05-2022 2/2 incriminating material and or looted article has been recovered from the possession of the petitioner. It is further submitted that other accused persons, namely, Md. Meraj vide Cr. Misc. No. 50318/2021 and Md. Noor Alam vide Cr. Misc. No. 48744/2021 have been granted bail by this Court. Petitioner is in custody since 27-08-2021 and the charge-sheet has been submitted in the matter.

Regards being had to the submissions made by the parties, taking into consideration the materials available on record and the fact that petitioner is in custody since 27-082021, the charge-sheet has been submitted in the matter and similarly situated co-accused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, NIRANJAN KUMAR @ CHOTTU @ CHHOTU KUMAR, be released on regular bail on furnishing bail bond of Rs. 10000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No.141 of 2021.
