Petitioner apprehends his arrest in connection with Tajpur P.S. Case No. 336 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 363, 365, 120B of the Indian Penal Code and Section 4 of POCSO Act. Allegation as per FIR is that 15-20 persons is that they came on motorcycles and assaulted the informant and others and it is also alleged that minor daughter of the informant was abducted by them. However, two of them were arrested and they have disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that the victim girl has not named this petitioner in her statement under Section 164 Cr.P.C. and further another co-accused having similar

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, Samastipur, in connection with Tajpur P.S. Case No. 336 of 2017, subject to the conditions under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
