The petitioner apprehends his arrest in connection with Madhdumpur P.S. Case no. 99 of 2019, registered under Sections 452, 341, 323, 324, 325, 326, 307 and 504 of the Indian Penal Code.

The accusation is that on 10.03.2019, six persons named in the F.I.R., including the petitioner, started to cause assault through Lathi and Khanti to Yashwant Kumar, brother of the informant. When informant made protest then Suraj Kumar caused injury to the informant through Khanti in which he sustained injury at his head and fracture injury at his hand. Learned counsel for the petitioner submits that, in

No.50506 of 2019(2) dt.14-08-2019 2/2 fact, occurrence of Marpit took place due to some petty dispute in which petitioner's side also sustained injury regarding which Makhdumpur P.S. Case No. 98 of 2019 was instituted on the basis of fardbeyan of Sadhua Devi, mother of the petitioner. Moreover, the injuries found on the person of brother of informant are simple in nature, whereas, out of five injuries as found on the person of informant, three injuries are simple in nature and opinion has been reserved regarding the two injuries. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Jehanabad in connection with Makhdumpur P.S. Case No. 99 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
