JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Gandhi Maidan P.S. Case No. 441 of 2016 registered for the offences punishable under sections 302, 201, 379 and 120B/34 of the Indian Penal Code.

Allegedly, Abhisekh Kumar and Sagar Kumar were killed by unknown. The name of the petitioner transpired in the confessional statement of co-accused Amit Kumar, Bholu and Mantosh Choudhary.

Submission is that similarly situated co-accused Sachidanand Kumar has been allowed bail vide Cr. Misc. No. 22007 of 2017 by another co-ordinate Bench of this court and

Patna High Court Cr.Misc. No.18696 of 2017 (2) dt.15-05-2017 2/2 petitioner is suffering in custody since 1.12.2016 and there is no other material against the petitioner which is evident from impugned order itself.

Learned A.P.P. fairly submits that in the confessional statement of co-accused, the name of the petitioner has transpired. In the facts and circumstances as stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-X, Patna in Sessions Trial No. 177 of 2017, arising out of Gandi Maidan P.S. Case No. 441 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
