The petitioners seek bail in Riga P.S. case No. 319 of 2015 under Section 307, 120B, 34 of the Indian Penal Code and under Section 27 of the Arms Act.

Six persons, including these two petitioners, are named in the FIR. The informant alleged that all the six persons made indiscriminate firing in which the informant got three fire arm injuries on wrist, right hand and right armpit. The learned counsel for the petitioner submits that similarly situated accused, Lal Babu Rai and Shashi Singh @ Shashi Kumar have already been granted bail vide orders passed in Cr. Misc. Nos. 34181 of 2016 and 9791 of 2017. The case of

Patna High Court Cr.Misc. No.20502 of 2017 (2) dt.04-05-2017 2/2 petitioner stands on the same footing. The petitioner is in jail since 09.06.2016.

Considering the facts that petitioner is in jail for more than nine months and similarly situated accused have already been granted bail, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Riga P.S. Case No. 319 of 2015.
