JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek regular bail in connection with S. Kamal P.S. Case No. 191 of 2021 instituted for the offences under Section 414 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 1685.880 litre of liquor from the house of petitioner no. 1 Raj Kumar. Learned counsel for the petitioners submits that the petitioners are in custody since 06.08.2021, are persons with clean antecedent and charge-sheet has been submitted in this

Learned counsel for the petitioners further submits that though the house belongs to petitioner no. 1 Raj Kumar but it was an abandoned house which was not in use and, as such, the petitioners were not aware who had kept the liquor in an abandoned house.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in this case let the petitioners above named be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise Act, Begusarai in connection with S. Kamal P.S. Case No. 191 of 2021, with condition that in the event, if the petitioners are implicated in case of similar nature in future then the learned court below will be at liberty to cancel the bail bonds of the petitioners.
