2. Petitioners seek regular bail in connection with Dalsingsarai P. S. Case No. 177 of 2023 in a case registered for the offence punishable under Sections 147, 149, 341, 323, 307, 354, 379, 504, 506 of the Indian Penal Code to which, Section 302 of the Indian Penal Code was added later on.
3. As per the prosecution case, the allegation against these petitioners is that petitioner No. 1 tried to hit the informant on his head which was stopped by him with his hands due to which informant's hands were injured whereas petitioner No. 2 assaulted the son and daughter of the informant.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.57690 of 2024(2) dt.06-12-2024 2/2 petitioners have falsely been implicated in this case due to land dispute. There is no specific allegation of any overt act done to the deceased Renu Devi. Charge sheet has been submitted. Petitioners have no criminal antecedent and petitioner no. 1 in custody since 07.09.2023 and petitioner no. 2 is in custody since 03.10.2023.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Dalsingsarai, District Samastipur in connection with Dalsingsarai P.
