JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2017 The appellant is in custody since 09.01.2017 in connection with Bihra P.S. Case No. 201 of 2016 registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504 of the Indian Penal Code and Sections 3(1)(x), 3(2)(v) SC/ST Act. It has been submitted on behalf of the appellant that though there is allegation as per F.I.R., against the appellant is of firing on that but not specifically mentioned. It appears from injuries and post mortem report no fire arm injury found on victim/deceased. Heard learned Special P.P. also.

Considering the aforementioned facts and circumstances, the period of custody and also that the appellant has no criminal antecedent, let the appellant above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned

Case No. 201 of 2016, with following conditions:- (i) One of the bailors of the appellant shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The appellant will not induce any witness or tamper with the evidence.

(iii) The appellant shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
