2. Heard learned counsel for the petitioner and learned A.P.P. for the State.
3. The petitioner seeks regular bail in connection with Araria (R.S.) P.S. Case No. 544 of 2021 dated 02.07.2021, lodged under Sections 394 & 411 of the I.P.C.
4. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 01.11.2022 passed in Cr. Misc. No. 38780 of 2022 in which liberty was granted to him to renew his prayer for bail six months after framing of charge.
5. Learned counsel for the petitioner further submits that the other co-accused person has been granted bail by the
Patna High Court CR. MISC. No.55004 of 2023(2) dt.22-09-2023 2/2 Co-ordinate Bench of this Court and thereafter, not appearing in this case since, long and he is unnecessarily being culprit in this case.
6. Learned counsel for the State opposes the prayer for bail and submits that the observation made by this Court has not been complied.
7. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner and, therefore, his bail petition is hereby rejected again.
8. With this observation, the bail application stands rejected.
