The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 420, 406, 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The prosecution case is that the informant's marriage was fixed with petitioner, when engagement was made and Rs. 1,20,000/- was given to the father and maternal uncle of the petitioner. Subsequently, further Rs. 1,00,000/- was demanded and marriage was not performed.
It is submitted by the learned counsel for the petitioner that the thrust of accusation against the father of the petitioner. Moreover, the informant has retracted from the initial version and filed a petition to that effect before learned
Patna High Court Cr.Misc. No.57144 of 2015 (2) dt.18-12-2015 court below and same has been brought on record. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Shashi Bhushan Kumar, J.M., Ist Class, Madhubani in connection with Bisfi P.S. Case No. 2097 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
