Petitioners are in custody since 29.12.2016 in connection with Puraini P.S. Case No. 111 of 2016 registered under Sections 307 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, has not committed any offence and has falsely been implicated in this case. In fact, the petitioners have not been named in the F.I.R. and merely on the basis of confessional statement of the co-accused, Asha Devi, they have been made accused in this case. Nothing has been recovered from the conscious possession of the petitioners nor the they have been put on T.I.P. till date. The petitioners are rotting in custody for more than three and half months
Patna High Court Cr.Misc. No.15988 of 2017 (3) dt.25-04-2017 Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class,, Udakishunganj, Madhepura in connection with Puraini P.S. Case No. 111 of 2016.
