JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture for non-fulfillment of the dowry demand. It is also alleged against this petitioner that he also inflicted torture and on his direction the complainant was driven out from matrimonial house.
It is submitted by the learned counsel for the petitioner that the accusation against the petitioner is omnibus and general. Thrust of accusation is against the husband of the complainant. It is further submitted that the husband of the complainant is ready to

No.47422 of 2016 (2) dt.28-10-2016 2/2 keep the complainant as wife with full dignity and honour, statement to that effect has been made in para 9 of the petition which reads as follows:- "That the husband of the complainant is still ready to keep his wife (complainant) with full dignity and honour."
Considering the thrust of accusation against the husband of the complainant, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura in connection with Complaint Case No. 1438 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
