This is an application for bail in connection with Maner P.S.Case No. 467 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons has killed the mother of the informant and after the occurrence they have fled away.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to village politics and the informant is only 18 years of age and there is no eye-witness to the occurrence and petitioner has remained in custody for three months.
Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.9177 of 2017 (2) dt.28-02-2017 2/2 for bail stating that there is direct allegation against the petitioner. Having heard both sides and considering the fact that there is direct allegation against the petitioner and other witnesses have supported the case of the prosecution, I am not inclined to grant bail to the petitioner.
The trial court is directed to expedite the trial of the petitioner.
With the above observation, this application is dismissed.
