The petitioner apprehends his arrest in Koilwar P.S. Case No.204 of 2017 registered under Sections 419, 420 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

The informant, District Programme Officer with the help of Circle Officer intercepted two vehicles bearing registration No.BR-03K-6416 and BR-03K-5507 loaded with foodgrains of 29 quintals 15 kg and 28 quintals respectively and arrested Sanjeet Kahar, Parshuram Paswan and Pawan Yadav. Sanjeet Kahar is said to have disclosed that Baccha Singh called her for stitching the bags.

No.5226 of 2018 (2) dt.02-02-2018 The learned counsel for the petitioner submits that save and except that one labour disclosed the name of the petitioner, there is no material against the petitioner to show that petitioner transported any foodgrains. The labour did not disclose the parental of the petitioner. Name of the petitioner is Baccha Sao @ Randhir Kumar but Sanjeet Kahar disclosed the name as Baccha Singh.

Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhojpur at Ara in connection with Koilwar P.S. Case No.204 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
