The petitioner seeks bail in Bheldi P.S. Case No. 115 of 2019, instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.
It is alleged in the written report filed by Chowkidar that dead body of one unknown lady was lying at Dabra river Hakma Chewar. The First Information Report has been lodged against unknown.
Counsel for the petitioner submits that name of petitioner has transpired during investigation on the basis of call details of the Mobile of the deceased Sweety Kumari which showed that she had talked with petitioner. Thereafter, Police recorded confessional statement of the petitioner. The
Patna High Court CR. MISC. No.50187 of 2019(2) dt.17-08-2019 2/2 mother-in-law of the deceased has already been granted bail by co-ordinate Bench of this Court vide order dated 1.8.2019 passed in Cr. Misc. 47138 of 2019.
Petitioner is in custody since 20.6.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-12th, Saran at Chapra, in connection with Bheldi P.S. Case No. 115 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
