JUSTICE SANJAY PRIYA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Azamnagar (Salmari O.P.) P.S. Case No. 350 of 2016 instituted for the offence under Sections-272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that 288 litres of Bengal made illicit liquor has been recovered from a tempo which was driven by this petitioner.

It has been submitted that petitioner was merely the driver of the tempo. The owner of the tempo is in custody. In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with

Patna High Court Cr.Misc. No.11061 of 2017 (3) dt.20-04-2017 2/2 two sureties of the like amount each in connection with Azamnagar (Salmari O.P.) P.S. Case No. 350 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Katihar subject to condition that both the bailors should be close relatives of the petitioner.
