1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Gopalganj Police Station Case No. 117 of 2025, dated 14.02.2025, disclosing offences under Sections 420/406/467/468/471/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report based on a written complaint filed by Deputy Superintendent, Sadar Hospital, Gopalganj, is that the services of the Staff Nurse Grade-A were terminated vide office order no. 409, dated 13.02.2025, pursuant to the letter no. 1231(6) and 313(6) issued by the Director-inChief (Nursing), Health Services, Patna, and Civil
Patna High Court CR. MISC. No.55400 of 2025(2) dt.27-08-2025 2/3 Surgeon, Gopalganj, respectively. Consequently, by office order no. 411 dated 14.02.2025, a further direction was issued to lodge an FIR against the concerned GNM personnel, who had allegedly secured appointment on the basis of forged and fabricated appointment letters.

Learned counsel for the petitioner submits that the petitioner, along with others, were appointed pursuant to the advertisement no. 02/2019 after due process of selection and verification of documents. He next submits that allegation that appointment letter were forged and fabricated is totally false and was not to the knowledge of the petitioner, as such, the petitioner is neither the creator nor fabricator of the appointment letter. He further submits that similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 44150 of 2025 and 43962 of 2025.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of
Patna High Court CR. MISC. No.55400 of 2025(2) dt.27-08-2025 3/3 anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Police Station Case No. 117 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
