Petitioner seeks bail in Lakhnaur P.S. Case No.191 of 2018 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

From seizure list, it appears that recovery of 547 litres foreign liquor has been made from the house of Ram Prit Das and Santosh Yadav. It is further alleged that name of the petitioner has been disclosed by co-accused.

Counsel for the petitioner submits that Petitioner is in custody since 15.07.2019 having clean antecedents. There is no recovery of liquor from conscious possession of the petitioner. In the facts and circumstances of the case, prayer of

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise Act, Madhubani, in connection with Lakhnaur P.S. Case No.191 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
