The petitioner is in custody since 27.05.2016 in connection with Kotwali (Adampur) P.S. Case No. 407 of 2015 registered for the offence under Section 384 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected vide order dated 16.05.2018 passed in Cr. Misc. No. 22382 of 2018 with a direction to the trial Court to expedite the trial. However, the trial, as submitted at the Bar, has not yet been concluded. It is submitted that the maximum punishment that can be given in a case under Section 384 of the Indian Penal Code is three years which period of custody has already been undergone by the petitioner.

In view of such facts and circumstances of the case,

Patna High Court CR. MISC. No.50489 of 2019(2) dt.14-08-2019 2/2 let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 407 of 2015.
