The petitioner seeks bail in a case registered under Section 363 of the Indian Penal Code. Later on, Sections 302, 201 of I.P.C. has been added.

Prosecution case, in short, is that informant filed a written report on 27.06.2019 that his son, namely, Suryadeo Sharma aged about 8 years went for play on door of accused with other boys but at about 4 p.m. he did not return at his house, then the informant made search.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.7.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.52946 of 2019(2) dt.23-08-2019 2/2 named in the F.I.R. His name has come in re-statement of the informant. Only suspicion has been raised against the petitioner. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in this case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Sharma, J.M. 1st, Bagaha, West Champaran in connection with Piprasi P.S. case No.32 of 2019.
