The petitioner, who is in custody, seeks bail in connection with Rajauli P.S. case No. 47 of 2016 instituted under Sections 302/34 of the Indian Penal Code.

The allegation, in brief, is that he along with his own brother killed his father by giving axe blow due to the partition dispute as a result of which he died instantly. It is submitted that except brother of the petitioner and mother of the petitioner there is no other witness and due to partition dispute the petitioner has falsely been implicated. Considering the aforesaid facts and circumstances of the case as allegation against petitioner is specific killing his father

Patna High Court Cr.Misc. No.3254 of 2017 (3) dt.08-02-2017 2/2 so prayer for bail is hereby rejected.

However the trial court is directed to expedite the trial of the petitioner and conclude it preferably within a period of one year.
