In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bath P.S. Case No. 61 of 2016 for the offences punishable under sections 406, 409 and 420 of the I.P.C.
Allegedly, the petitioner being Chairman of Naya Gaon PACS misappropriated 4289-23 quintals of C.M.R. The learned counsel for the petitioner submits that the petitioner is ready to deposit the said CMR in three equal installments within three months without going into the merits of the case. The learned A.P.P. fairly submits that if the petitioner is ready to deposit then lenient view can be taken. In the facts and circumstances as stated above, the

No.47296 of 2016 (2) dt.13-12-2016 2/2 petitioner is directed to surrender in the court below within one month from the date of receipt/production of a copy of this order then he shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-XIII, Bhagalpur in connection with above mentioned case with condition that the petitioner shall deposit 4289-23 quintals of CMR within three months and then after deposit his ad-interim bail granted shall be confirmed by the learned court below itself and in case of failure his bail granted should be deemed to be cancelled.
