The petitioner seeks regular bail in connection with Muzaffarpur Rail PS case no. 136 of 2019 instituted for the offences punishable under Sections 370 of Indian Penal Code and 75/79 of J.J. Act.

The allegation is regarding the petitioner having been found sitting on the railway platform along with 10 minor children. It is the allegation of the prosecution that the petitioner was taking the children for working in the factory. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, is languishing in custody since 27.06.2019 and is having a

Patna High Court CR. MISC. No.50149 of 2019(3) dt.30-09-2019 2/2 clean antecedent. It is further submitted that the petitioner had not forced any of the children to accompany him. The learned A.P.P. Sri Ashok Kumar submits that the petitioner was engaging in child labour, hence he should not be granted bail.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Railway, Sonepur (Saran) at Chapra in connection with Muzaffarpur Rail PS case no. 136 of 2019.
