The petitioner seeks bail in a case instituted under Sections 363, 366A and 379/34 of the Indian Penal Code. The prosecution story, in brief, is that the petitioner along with others kidnapped the niece of the informant namely Dharmshila Devi on the point of pistol, while she had gone to answer call of nature to the west of the village. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.01.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been
Patna High Court Cr.Misc. No.8493 of 2017 (2) dt.15-03-2017 2/2 made accused due to mistake of fact. The petitioner has already married with the victim. They have been blessed with three children. The matter has already been compromised between the parties, vide Annexure-2 to the present application. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M.P.Singh, Judicial Magistrate, 1st Class, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No. 204 of 1998.
