The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections-147, 148, 353 of the Indian Penal Code and 27 of the Arms Act. The prosecution case as per self statement of A.S.I. Amrendra Kumar, SHO. Tehta O.P. P.S. is to the effect that on 1508-2017 at 6.30 P.M., he received confidential information through telephone that the petitioner along with his associates were raising slogan against the police administration and were resorting to firing to create terror.
It is submitted on behalf of the petitioner that due to inimical relationship with the police, police also registered several
Patna High Court Cr.Misc. No.9656 of 2018 (2) dt.17-02-2018 other cases with similar accusation as mentioned in paragraph-3 of the petition. No injury was caused to anyone. Learned counsel for the petitioner submits that the petitioner is accused in several cases. It has also been submitted that the other co-accused namely Manish Kumar, has been granted anticipatory bail by a coordinate bench of this court vide order dated 04-01-2018 passed in Cr. Misc. No. 62288 of 2017.
Considering the fact that no injury was caused to any one, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 222 of 2017 , subject to the conditions as laid down under Section-438(2) of the Cr.P.C.
The bail bond of the petitioner will be accepted by the court below provisionally and if the petitioner is found involved in the cases of similar nature, the bail bond of the petitioner will be cancelled by learned court below.
