2. The petitioners are in custody in connection with Alamganj P.S Case No. 309 of 2023 registered for the offences punishable under Sections 407/409 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that this is a second bail attempt of the petitioners and the petitioners are in custody since 22.04.2023. Earlier the bail application was rejected vide order dated 22.02.2024 passed in Cr. Misc. No. 62644 of 2023 with liberty to the petitioners that if the trial is not concluded within a period of one year, they shall renew the prayer for bail in the trial Court as mentioned in Paragraph 9 of the rejection order of this Court. Thereafter, petitioners have moved to the Hon'ble

Patna High Court CR. MISC. No.64968 of 2025(4) dt.07-11-2025 2/2 Apex Court vide Special Leave to Appeal No. 13244 of 2024 and the same has dismissed.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.

6. On perusal of records, it appears that petitioners have moved to Hon'ble Apex Court vide Special Leave to Appeal No. 13244 of 2024 and the same has been dismissed in light of Paragraph 9 of the rejection order of this Court. From the report sent by the Trial Court vide letter no. 76 dated 20.09.2025, it appears that trial has not been concluded as yet and Investigating Officer is yet to be examined. So, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Alamganj P.S Case No. 309 of 2023 subject to the condition that petitioners shall remain physically present on each and every date fixed by the Trial Court and if the petitioners fails to appear on two consecutive dates, the concerned Trial Court is at liberty to cancel the bail bond of the petitioners.
