JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-04-2018 The petitioner is apprehending his arrest in connection with Chhauradano P.S. Case No. 40/2015, registered for offences punishable under Sections 420, 409, 467, 468 and 471 of the Indian Penal Code.

Petitioner is the Ex - PACS President and allegation against him that he withdrew the amount from the account of altogether twelve persons including informant by committing forged signatures.

It has been submitted on behalf of the petitioner that out and out false and concocted allegations have been made and it is not possible for anyone to withdraw the amount from the bank of accounts of other persons on withdrawal form and as a matter of fact informant and others have taken loan from the bank and when

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and on his surrender the court below shall release the petitioner on provisional bail till submission of charge-sheet to his own satisfaction with condition that he will cooperate in investigation and once charge-sheet is submitted and the case is found true against the petitioner, he will have to surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available at that time.

With the above direction, this application is disposed of.
