2. Heard learned counsel for the petitioner and learned A.P.P for the State.
3. Learned counsel for the petitioner is directed to make necessary correction at Para. 4 of the bail petition during the course of the day.
4. The petitioner has preferred this application for grant of regular bail in connection with K. Hat (Maranga) P.S. Case No. 728 of 2022(Special (POCSO) No. 105 of 2022) dated 21.07.2022 registered for the offences punishable under Sections 341, 323, 363, 366A, 504 and 506 read with 34 of the
Patna High Court CR. MISC. No.55400 of 2023(2) dt.31-08-2023 2/3 Indian Penal Code.
5. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant by enticing her for the purpose of marriage.
6. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. There was love affair between both the parties. Learned counsel further submitted that there is nothing on record which shows that the victim was forced to have illicit relationship with another person. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.08.2022.
7. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
8. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with K. Hat (Maranga) P.S. Case No. 728 of 2022(Special (POCSO) No. 105 of 2022).
