The petitioners apprehend their arrest in Complaint case No. 760-C/2011 for the offence allegedly committed by them under Section 323, 380, 384 of the Indian Penal Code. The complainant named the petitioners along with other accused persons and made omnibus and general allegation that the petitioners came to his Darwaja for taking extortion and when the complainant went inside the house the accused persons entered into the house. Abdullah Ansari snatched the bag and fled away from the house.

The learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.39170 of 2016 (3) dt.04-10-2016 2/2 on 08.08.2011 petitioner No.1, Hotekatta Ansari @ Samiullah Ansari, filed Ramnagar P.S. case No. 211 of 2011 against the complainant and other accused persons for making assault with intention to kill him and in retaliation thereof the complainant filed this case.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bagaha, West Champaran in Complaint Case No. 760-C of 2011 (Trial No. 4456 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
