JUSTICE SANJAY PRIYA ORAL ORDER 03-04-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No. 462 of 2017, G.R. No. 4079/17 instituted for the offence under Sections 147, 148, 149, 341, 323, 342, 504, 506, 324, 307, 353, 188, 333, 427, 379, 120(B) of the Indian Penal Code, Section 27 of the Arms Act and Sections 4/40(8) of B.M.M.C. Act.

It is alleged in the written report that on secret information the informant along with Police Party went nearby Chandralaya Petrol Pump where he found large quantity of illicit liquor hidden beneath the sand and at that time 30-40 people gathered with arms and started abusing the informant and other police party.

Patna High Court Cr.Misc. No.6703 of 2018 (4) dt.03-04-2018 2/3 Learned counsel for the petitioner has submitted that although the petitioner is named in the written report but there is general and omnibus allegation against him. It has further been submitted that other co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 02.02.2018 passed in Cr. Misc. 3527 of 2018. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Hajipur Sadar P.S. Case No. 462 of 2017, G.R. No. 4079 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, subject to the conditions as laid down under Section 438 (2) Cr. P.C.

Patna High Court Cr.Misc. No.6703 of 2018 (4) dt.03-04-2018 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioner.
