The petitioner apprehends his arrest in connection with Mohaniya P.S. Case no. 224 of 2019, registered under Section 414 of the Indian Penal Code and Section 11 of the Animal Cruelty Act.

The accusation is that four buffaloes were found loading on Pickup van bearing registration No. UP-65-BT5703. On seeing the crowd, the persons boarded on the said vehicle succeeded to flee away.

Learned counsel for the petitioner submits that, in fact, four buffaloes were loaded on the pick up van, which was owned by the Shushila Devi, wife of Girija Yadav. The petitioner was carrying the buffaloes of a businessman

Patna High Court CR. MISC. No.51441 of 2019(2) dt.19-08-2019 2/2 loading on the pick up van, but due to highhandedness of the villagers, the petitioner left the pick up van. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhabua in connection with Mohaniya P.S. Case No. 224 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
