2. The petitioner seeks bail in connection with Lodipur P.S. Case No. 205 of 2024 instituted for the offences under Sections 304, 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per prosecution case, one unknown miscreant has snatched the golden chain weighing about 18 gram from the neck of Informant's mother.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the
Patna High Court CR. MISC. No.54726 of 2025(2) dt.18-08-2025 2/3 present case merely on the basis of suspicion. The petitioner is not named in the F.I.R. and his name has transpired in this case in course of investigation that too after five months of the alleged occurrence when one accused Faiyaz @ Pital was arrested by the police in another case i.e. Kotwali P.S. Case No. 34 of 2025 in which he has identified the petitioner in the CCTV footage. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has not been put to T.I. Parade till date and except disclosures made by the Faiyaz @ Pital, there is nothing adverse against the petitioner. The petitioner has four criminal antecedents but, in all of them, he is on bail and is languishing in judicial custody since 14.04.2025 without any rhymes or reason.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the
Patna High Court CR. MISC. No.54726 of 2025(2) dt.18-08-2025 3/3 petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Lodipur P.S. Case No. 205 of 2024.
