The petitioner is apprehending arrest in a case registered for the offences punishable under sections 143,323,354,307,379 and 504 of the Indian Penal Code. It is alleged that the petitioner assaulted the informant with farsa and co accused Jitendra undressed the daughter in law of the informant when co accused Teena Kamat took away two thousand rupees whereas co accused Manoj snatched mangal sutra worth rupees fifteen thousand from the daughter in law of the informant.
It is submitted by the learned counsel for the petitioner that though the injury of the informant is near eye and has been found to be grievous but the case lodged by the petitioner side is at
Patna High Court Cr.Misc. No.55378 of 2015 (2) dt.07-12-2015 2/2 earlier in point of time. There is no accusation of repeating the blow. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Babubarhi P.S. Case No. 27 of 2015 pending in the court of learned ACJM II, Madhubani. This application is disposed of with the aforesaid observation/direction.
