The petitioner apprehends his arrest in Dhanaha P.S. Case No.219 of 2017 registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The police officer got information that two persons were carrying liquor on such the police intercepted the vehicle and arrested both the persons who disclosed their name as Reyajuddin Ansari and Krishna Kushwaha and from the motorcycle, country made liquor was recovered. Reyajuddin Ansari is said to have disclosed that he purchased the country made liquor from Uttar Pradesh to deliver the same to Santosh Rao, the petitioner. The learned counsel for the petitioner submits that nothing has been recovered from the house of the petitioner and

No.5356 of 2018 (2) dt.02-02-2018 save and except the statement of Reyajuddin Ansari, there is no material to show that the petitioner ever indulged in illegal trade of country made liquor. Petitioner has got no criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Dhanaha P.S. Case No.219 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
