The petitioner apprehends arrest in a case registered for the offence punishable under section 395 of the Indian Penal Code and section 27 of the Arms Act.

Prosecution case is that some unknown miscreants looted cash Rs. 23,000/- and mobile phone from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR and the only material that has come against this petitioner is that he was found talking with one of the co-accused on mobile phone. No tangible evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Baslia Police Station Case No. 349 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
