In this case, the petitioner is challenging the order dated 26.08.2015 passed in Cr. Rev. No. 24 of 2015 by the Sessions Judge, Sheikhpura, who has dismissed Cr. Rev. No. 24 of 2015 filed against the order dated 13.05.2015 passed by the Chief Judicial Magistrate, Sheikhpura in G.R. No. 466 of 2013, arising from Sheikhpura P.S. Case No. 150 of 2013 for offence under section 376 (2) (c) of the Indian Penal Code. A serious matter has been brought to notice of this Court that a victim lady is a under trial prisoner is in confinement, within four walls of jail, has alleged that she was forcibly put
Patna High Court Cr.Misc. No.1250 of 2016 (2) dt.08-08-2016 2/2 to sexual abuse by the accused persons. Allegation has been made against three accused persons and one person is Devendra Jamadar, who is a Police Jamadar.
When the victim is in confinement, is supposed to be under the protection of jail authority, has committed sexual offence along with two prisoners itself shows savagery of perpetrator. The court below rightly rejected the revision application. The court below is directed to expedite the trial and conclude the same within the period of six months from the date of receipt/production of a copy of this order. The Disciplinary Authority of Devendra Jamadar is directed to initiate a department proceeding if already not initiated against him, conclude the same within three months from the date of receipt/production of a copy of this order.
