Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Baruraj P.S. Case No. 126 of 2016 lodged under Sections 304(B) and 201/34 of the I.P.C.
As per the prosecution, the allegation of section 304(B) of I.P.C. is there in the F.I.R. in which accused has been made to the entire family members.
Learned counsel for the petitioner submits that after framing of charge, evidences has been adduced and from Annexure-2, it transpires that informant has deposed his evidence in which he has changed his earlier version as made in
Patna High Court CR. MISC. No.58051 of 2022(3) dt.24-02-2023 2/2 the F.I.R..
Learned counsel for the State opposes the prayer for bail and submits that stage of trial may be called for from the trial court.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Baruraj P.S. Case No. 126 of 2016, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
Trial Court is directed to expedite the trial within three months.
With this observation, the bail application stands allowed.
