JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail as the petitioner apprehends arrest in Complaint Case No. 564 of 2012 registered for the offence punishable under Section 498-A. The petitioner is the husband of the opposite party No. 2, to whom notice was ordered to be issued on 11.12.2013. Despite service of notice upon her, the opposite party has chosen not to appear.

Learned Senior Counsel appearing on behalf of the petitioner submits that allegations of demand of dowry and torture therefor by the petitioner against the complainant is absolutely incorrect. He submits that admittedly there is a matrimonial dispute between

No.47162 of 2013 (4) dt.20-01-2015 P2/2 the petitioner and opposite party No. 2 and contends, with reference to the order dated 30.09.2013 passed by learned Sessions Judge, Rohtas, Sasaram in A.B. Petition No. 1908 of 2013 that the petitioner had already obtained decree of divorce from Family Court, Buxar.

In view of the nature of dispute between the parties and in view of the submissions made on behalf of the petitioner as noted above, let the petitioner Ranjit Ray, in the event of his arrest / surrender within six weeks from today before the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount, each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, in connection with Complaint Case No. 564/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
