The petitioner apprehends her arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., this petitioner was staring towards the house of informant and in the meantime, other F.I.R. named coaccused persons fired upon informant's son, on account of which, he died on way to hospital.

It is submitted on behalf of petitioner that there is no specific overt act against this petitioner. Though, after investigation, police submitted final form showing the case not true against the petitioner, but differing with the same, the learned Chief Judicial Magistrate took cognizance against petitioner and all F.I.R. named co-accused persons. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.54226 of 2022(2) dt.20-12-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Begusarai Muffasil (Singhaul O.P.) P.S. Case No. 206 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
