JUSTICE SHIVAJI PANDEY ORAL ORDER 02-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Sahebpur Kamal P.S. Case No.372 of 2017, registered for the offence punishable under Section 498(A) of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.
Allegation has been made that there is demand of dowry and on non fulfillment of said demand the family members started torturing the informant, to resolve the dispute many a time the Panchayati was called for, but the petitioners continued to torture the informant.
Patna High Court Cr.Misc. No.5966 of 2018 (2) dt.02-02-2018 2/2 Petitioner no.1 is the father-in-law of the informant, petitioner nos. 2 and 3 are the villagers and petitioner no.4 is the mother-in-law of the informant.
Looking to the nature of allegation, let the abovenamed petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Begusarai, in connection with Sahebpur Kamal P.S. No.372 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
