JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
The prosecution case is that on 26.05.2015 at 9:30 P.M the son-in-law of the brother of the informant was parking motorcycle in the courtyard of the informant. On protest being raised, the scuffle took place when petitioner Nos. 1 and 2 assaulted the informant.
It is submitted by learned counsel for the petitioners that for a petty dispute the occurrence took place. It is further submitted that though some of the injuries of the informant has been found to be grievous, but subsequently the informant has retracted from the initial version and has filed a petition to that effect before learned Court below.
Patna High Court Cr.Misc. No.55709 of 2015 (2) dt.09-12-2015 2/2 Let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Barsoi P.S. Case No. 97 of 2015, pending in the Court of learned Chief Judicial Magistrate, Katihar.
With the observations above, the application stands disposed off.
