JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 387 and some other allied Sections of the Indian Penal Code. As per the prosecution case, this petitioner along with other accused persons having armed with Lathi-Danda caught the informant and asked him to transfer his land and on denial co-accused, Birendra Pandey pressed his neck and this petitioner forcibly took his signature on a plain paper and assaulted the informant with Danda as a result of which his hand got fractured.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.64259 of 2021(2) dt.23-05-2022 2/2 case. There is land dispute between the parties. No such occurrence as alleged in the FIR has ever taken place and there is no injury report on record. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua PS case No.342/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
