JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code.

The prosecution case is that the petitioner being the Block Development Officer-cum-Block Election Officer, Simri Bakhtiyarpur, allowed one Pankaj Kumar Jha to contest election of the Chairman, PACs of Baghwa Panchayat, though, he was working in the Uttar Bihar Gramin Bank, Balahat. It is submitted by learned counsel for the petitioner that though the accusation was raised at the time of filing of nomination but proper enquiry was made from the Uttar Bihar Gramin Bank when it was found that Pankaj Kumar Jha is not employee of the Bank then nomination was accepted. Moreover,

Patna High Court Cr.Misc. No.56695 of 2015 (2) dt.15-12-2015 2/2 now the election is over and due remedy is available for the informant by way of filing election petition. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Bakhtiyarpur P.S. Case No.170/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
